1. Acceptance of Terms

By accessing or using the Florence and Leo platform ("Platform", "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. These Terms constitute a legally binding agreement between you and Florence and Leo ("we", "us", "our").

You must be at least 18 years of age to use this Platform. By confirming the age gate, you represent and warrant that you are 18 years of age or older.

2. Description of Service

Florence and Leo is a subscription-based content platform offering photography, video, and audio content across two sections: For Friends (non-adult content) and For Lovers (adult content). Content is available at four access tiers: Public, Guest, Friends, and Lovers.

We also offer physical merchandise and fine-art photography prints for purchase. Merchandise and print purchases do not require a subscription.

3. User Obligations

You agree that you will not:

• Download, copy, redistribute, or share any content from the Platform without our express written permission.
• Use automated tools, bots, scrapers, or crawlers to access or collect content from the Platform.
• Circumvent, disable, or interfere with any security features or access controls on the Platform.
• Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
• Share your account credentials with any third party.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. Payment Terms

Subscription fees are billed on a recurring monthly or yearly basis, as selected at checkout. All fees are stated in US dollars and are non-refundable except as required by applicable law.

Friends-tier subscriptions are processed by Stripe. Lovers-tier subscriptions are processed by Segpay. By subscribing, you authorise the applicable payment processor to charge your payment method on a recurring basis.

If a payment fails, we will retry according to the payment processor's dunning schedule. After three consecutive failed payments, your subscription will be downgraded to the Guest tier.

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period.

5. Intellectual Property

All content on the Platform — including photographs, videos, audio recordings, text, and design elements — is owned by or licensed to Florence and Leo and is protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-transferable, non-exclusive licence to view content for personal, non-commercial use only.

6. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Florence and Leo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid us in the twelve months preceding the claim.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Florence and Leo is established, without regard to its conflict of law provisions.

9. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
